Fair Play Task Force Kick Off Meeting (Aus/Pacific and West Coast America)

Legal barriers remain one of the biggest obstacles in the preservation of complex and interactive digital content around the world. In recent times, preservationists have made some progress in the USA by leveraging Fair Use. But what about elsewhere? Trying to influence or wait for law reform in individual jurisdictions around the world is likely to be slow and fraught with difficulties.

A new DPC Fair Play Task Force has been established to develop evidence, reasoning and global support for a more practical approach to preservation in a challenging legal environment. Individual organizations, and local consortia could then potentially draw on this resource, and the combined support of the Coalition, when local advocacy opportunities arise.

The Task Force will seek ways to support reasonable and timely preservation action that will deliver positive outcomes for society without impacting on the commercial interests of copyright holders. We will champion the balance in copyright law that delivers benefit for the public in return for appropriate protection of intellectual ownership.

Open to DPC Members, the Task Force will meet on a regular basis to discuss and take forward the aims of the group. It will seek to engage and partner with other like-minded organizations as appropriate to its aims.

The Task Force will work to deliver the following indicative outputs, which will be defined and developed more exactly in due course:

  1. A summary assessment of legal obstacles to preservation and access in different legal jurisdictions.

  2. A set of international case studies that will help to communicate the issues faced and approaches taken to preserve and increase access

  3. A broader package of materials, quotes, evidence and arguments to support action and advocacy in this area.

  4. A plan of commitment to support, make the case and back up the arguments of those on the ground seeking change or new approaches in this field.

  5. Engagement with industry bodies, advocating for reasonable preservation and access

The support outlined above will begin to change how we can use emulation to preserve the world’s knowledge and culture, potentially enabling (for example) organizations to be less risk averse when providing access to orphaned works. 

Two launch meetings (held to cover different time zones) will provide an opportunity for DPC Members to discuss, contribute to and shape the plans for this Task Force. This meeting will be best for those in Australia/Pacific and West Coast North America.
